Board of Contract Appeals General Services Administration Washington, D.C. 20405 ____________________________ June 26, 2006 ____________________________ GSBCA 16885-TRAV In the Matter of RUSSELL O. JENKINS Russell O. Jenkins, Oakland, CA, Claimant. Judy Hughes, Travel Management & Procedures Office, Defense Finance and Accounting Service, Columbus, OH, appearing for Department of Defense. PARKER, Board Judge. On March 27, 2006, Russell O. Jenkins filed for the first time a claim with the Department of the Navy for "approximately $20,000" in unpaid per diem allegedly due her in connection with her civilian employment in Vietnam as of February 1974. Ms. Jenkins has asked the Board to review the Navy's decision that her claim is barred by the statute of limitations applicable to such claims. The Navy's decision was correct; the claim is time barred. Statute requires that a claim against the Government by federal civilian employees for official travel and transportation, or for relocation expenses incident to transfers of official duty station, be received by the Administrator of General Services [Foot # 1 ] or by the agency that conducts the activity from which the claim arises within six years after the claim accrues. 31 U.S.C. 3702 (2000); Dale B. Thompson, GSBCA 16814-RELO (May 4, 2006). Because Ms. Jenkins did not file a claim until more than thirty-six years after her claim accrued, the statute bars consideration of it. ****************** Footnote Begin ********** [Foot # 1 ] The Administrator has delegated to the Board the power to settle these claims. GSA Order ADM P 5450.39C CHGE 78 (Mar. 21, 2002). ****************** Footnote End ************ Decision The claim is dismissed. ________________________ ROBERT W. PARKER Board Judge
