The claimant is not entitled to reimbursement of real estate expenses incurred in selling a residence at other than the old duty station, in conjunction with a relocation, when the claimant did not regularly commute to and from work from that residence. 5 U.S.C.A. 5724a(d)(1) (West Supp. 1998); 41 CFR 302-6.1 (1997). The claimant, David A. Gates, changed permanent duty stations from Grand Junction, Colorado, to Salt Lake City, Utah, in late 1994 or early 1995. He did not relocate his family, which remained in a residence at Grand Junction. The claimant did not commute to and from work between Colorado and Utah. In April 1997, under another relocation, the claimant reported for duty at a new official station, in Farmington, New Mexico. He sold the residence in Colorado on August 22, 1997. He seeks to be reimbursed $4,830 in connection with that sale. The agency has disallowed the request in conjunction with the latest change of duty stations because reimbursement is limited to the sale of a residence at the old duty station, Salt Lake City, Federal Travel Regulation (FTR) 302.6-1, 41 CFR 302-6.1 (1997), and the claimant did not regularly commute to and from work between Colorado and Utah (although he traveled between the two locations on weekends), 41 CFR 301-1.4(k). Under statute, 5 U.S.C.A. 5724a(d)(1) (West Supp. 1998), and the cited regulations, for the reasons stated by the agency, the claimant is not entitled to reimbursement for the sale of the residence in Colorado in conjunction with the most recent permanent change of station.
