Board of Contract Appeals General Services Administration Washington, D.C. 20405 October 27, 1999 GSBCA 15100-RATE In the Matter of TRI-STATE MOTOR TRANSIT CO. Beverly Reding, Manager of Revenue Accounting, Tri-State Motor Transit Co., Joplin, MO, appearing for Claimant. James F. Fitzgerald, Director, Audit Division, Federal Supply Service, Washington, DC, appearing for General Services Administration. Colonel James F. Quinn, Staff Judge Advocate, Headquarters, Military Traffic Management Command, Department of the Army, Falls Church, VA, appearing for Department of Defense. DANIELS, Board Judge (Chairman). Tri-State Motor Transit Co. asked us to review the denial, by the Audit Division of the General Services Administration's Federal Supply Service, of the carrier's claim for additional payment for transporting a shipment of rockets for the Department of the Army in March 1996. The Audit Division had rejected the claim as untimely filed. In response to the filing of this case, the Audit Division reexamined the matter. It agreed with the carrier as to both the timeliness and the merit of the claim. It consequently issued a settlement certificate granting full payment. The carrier then acquiesced to a dismissal of the case. Accordingly, the case is dismissed. __________________________ STEPHEN M. DANIELS Board Judge
