Tri-State Motor Transit Co. asked us to review the denial by the General Services Administration's Office of Transportation Audits (OTA) of twenty-five claims relating to the carrier's transportation of heavy expanded mobility ammunition trailers for units of the Department of Defense. We granted twenty-two of the claims. Because OTA had not yet rendered decisions on the remaining three claims, we dismissed without prejudice Tri- State's request for review of those matters. In taking this action, we noted, "If, after OTA resolves any of the three claims, Tri-State is dissatisfied with the determination, the carrier may ask us to review OTA's action." Tri-State Motor Transit Co., GSBCA 14352-RATE (Jan. 6, 1998). Subsequently, Tri-State received OTA denials of those three claims and asked us to review the agency's determinations. In response, OTA changed its position and issued settlement certificates which state that "there is due from the United States" to Tri-State the amounts claimed.
