Board of Contract Appeals General Services Administration Washington, D.C. 20405 February 18, 1998 GSBCA 14456-RATE In the Matter of DIABLO TRANSPORTATION, INC. Robert D. Norcom, Auditor, Diablo Transportation, Inc., Joplin, MO, appearing for Claimant. Jeffrey J. Thurston, Director, Office of Transportation Audits, General Services Administration, Washington, DC, appearing for General Services Administration. Colonel James F. Quinn, Staff Judge Advocate, Headquarters, Military Traffic Management Command, Department of the Army, Falls Church, VA, appearing for Department of Defense. DANIELS, Board Judge (Chairman). Diablo Transportation, Inc., claimed that it was entitled to receive $81.75 more than the Government had previously paid for transporting vehicles from Edwards Air Force Base, California, to San Diego, California. The claim was predicated on the inclusion on the Government bill of lading of a statement that the value of the shipment was greater than the "released value" prescribed in Item 190 of Military Traffic Management Command Freight Traffic Rules Publication No. 1A. The General Services Administration's Office of Transportation Audits has now issued a settlement certificate which states that "there is due from the United States" to Diablo the entire amount claimed. Since the claimant no longer objects to the Government's determination, we dismiss the case. _________________________ STEPHEN M. DANIELS Board Judge
