Board of Contract Appeals General Services Administration Washington, D.C. 20405 April 10, 1998 GSBCA 14368-RATE In the Matter of TRI-STATE MOTOR TRANSIT CO. Robert D. Norcom, Auditor, Tri-State Motor Transit Co., Joplin, MO, appearing for Claimant. Jeffrey J. Thurston, Director, Office of Transportation Audits, General Services Administration, Washington, DC, appearing for General Services Administration. Col. James F. Quinn, Staff Judge Advocate, Headquarters, Military Traffic Management Command, Department of the Army, Falls Church, VA, appearing for Department of Defense. GOODMAN, Board Judge. On December 29, 1995, Tri-State Motor Transit Co. (Tri- State) submitted a voucher for a primary claim in the sum of $2,690.90 and an alternate claim in the sum of $165.90 to the Defense Finance and Accounting Service (DFAS). Tri-State submitted the supplemental claims seeking reimbursement for additional transportation charges on Government bill of lading D- 0,908,413. DFAS did not pay the supplemental claims and Tri- State filed a claim with the General Services Administration's (GSA's) Office of Transportation Audits (OTA). GSA OTA issued a settlement certificate allowing the alternate claim of $165.90, but deneid the primary claim of $2,690.90. Tri-State filed a request for review at this Board. By letter dated November 26, 1997, in response to Tri-State's request for review, GSA OTA stated that it had reviewed the record and was consequently issuing a settlement certificate for $2,525, the difference between the primary claim and the alternate claim, which was previously paid. On April 9, 1998, GSA OTA provided the Board with a copy of the settlement certificate. Accordingly, the claim is dismissed. ___________________________ ALLAN H. GOODMAN Board Judge
