McKenzie Tank Lines, Inc. (MCKE) asks us to review post- audit deductions that were taken from payments it received for hauling fuel from Eglin Air Force Base to Duke Field. Although MCKE's submission to us mentions a number of invoices, the Office of Transportation Audits (OTA) says that only two of the invoices were for hauling fuel between those two points. MCKE does not dispute OTA's statement. The Government Bills of Lading (GBLs) associated with the two invoices are numbered D-3,135,678 and D- 3,135,693. OTA says that MCKE never filed a protest with OTA concerning either of these two GBLs, and MCKE does not disagree with OTA. The statute and regulations that govern claims for transportation services provide that MCKE must present OTA with a protest before asking us for review. 41 CFR 101-41.503 (1996). When MCKE presents its protest to OTA, it should ensure that it provides OTA with sufficient information, including all amendments to its tariff, to enable OTA to review the claim properly. If MCKE is not satisfied with OTA's decision, MCKE can then ask us to review that decision.
