DISMISSED WITH PREJUDICE: October 6, 1993 GSBCA 12601-P RMTC SYSTEMS, INC., Protester, v. DEPARTMENT OF THE NAVY, Respondent. Jeff Stollman, President of RMTC Systems, Inc., Boulder, CO, appearing for Protester. Douglas Larsen, Office of Counsel, Naval Supply Systems Command, Arlington, VA, counsel for Respondent. NEILL, Board Judge. ORDER This protest was filed by RMTC Systems, Inc. on October 1, 1993. Protester complains that its offer to supply automatic data processing equipment to the Navy was mistakenly rejected as non-compliant with the requirements of the solicitation. On October 4, the Board convened a prehearing conference. At that time, it became clear that protester, despite an earlier request, had not been provided information sufficient to confirm the memory requirement called for in amendment one of the solicitation. Following the conference, counsel for respondent furnished the information to protester. Upon examining the information, protester filed with the Board a motion to dismiss the protest with prejudice. Counsel for the respondent is aware of this motion and has indicated to the Board that there is no objection to it. Accordingly, this case is DISMISSED WITH PREJUDICE.
