_________________________________ GRANTED: June 29, 1993 _________________________________ GSBCA 12274-C(12021-P) AST RESEARCH, INC., Intervenor, v. DEPARTMENT OF THE AIR FORCE, Respondent. William W. Goodrich and John J. O'Brien of Arent Fox Kintner Plotkin & Kahn, Washington, DC, counsel for Intervenor AST Research, Inc. Clarence D. Long, III and Joseph M. Goldstein, Office of General Counsel, Department of the Air Force, Washington, DC, counsel for Respondent. Before Board Judges HENDLEY, HYATT, and VERGILIO. HYATT, Board Judge. Pursuant to Rule 35 of the Board's Rules of Procedure, on January 22, 1993, AST Research, Inc. timely moved for an award of protest costs in the amount of $36,814.14. The underlying protests, in which AST intervened, challenged an award by the Department of the Air Force of a contract to Zenith Data Systems Corporation for the acquisition of microcomputer systems to support general purpose applications, including standard office automation functions such as word processing, data base management, and business graphics. The award was made under a procurement commonly referred to as "Desktop IV." Four protests were filed by CompuAdd Corporation (GSBCA 12021-P), Electronic Data Systems Corporation (GSBCA 12028-P), Government Services Technology, Inc. (GSBCA 12041-P), and Apple Computer, Inc. (GSBCA 12042-P). AST actively intervened in support of all four protests, and supported the grounds upon which the protests were ultimately granted. See CompuAdd Corp. v. Department of the Air Force, GSBCA 12021-P, et al., 1993 BPD 48, at 5 (Dec. 23, 1992). In a letter dated June 23, 1993, the parties advised the Board that they have reached an agreement that seventy-five percent of the costs originally claimed by AST should be awarded. The parties have thus requested that the Board issue an order awarding the amount of $27,610.64 to AST. Based on the settlement agreement and our independent review of the supporting documentation submitted by AST with its motion, we find that these costs were proper and reasonable. Sterling Federal Systems, Inc. v. National Aeronautics and Space Administration, GSBCA 10000-C(9835-P), 92-3 BCA 25,118, 1992 BPD 141. Accordingly, we grant AST's motion for costs in the revised amount agreed upon by the parties. Decision Protester's motion, as amended by the settlement agreement of the parties, for reimbursement of costs in the amount of $27,610.64 is GRANTED. This award may be paid, without interest, from the permanent indefinite judgment fund, 31 U.S.C. 1304 (1988). 40 U.S.C. 759(f)(5)(C) (1988). _____________________________ CATHERINE B.
