                              ORDER

    On November 10, 2004, appellant, Pacific Construction Services, Inc., appealed a
contracting officer's decision terminating for default its contract to upgrade restroom
facilities at the Harold Washington Social Security Center located in Chicago, Illinois.  On
August 9, 2005, the parties filed a joint motion for dismissal, stating that they have settled
this matter.  Accordingly, this appeal is DISMISSED WITH PREJUDICE.  Rule 128.
