ORDER This case concerns the termination for default of a series of purchase orders issued under various contracts which Midland Supply, Inc. (Midland) has with the General Services Administration. The contracting officer's decision to terminate the orders was issued on April 8, 2004. Midland promptly appealed the decision to this Board. By letter dated May 20, 2004, counsel for Midland advised the Board that the decision to terminate has been rescinded and that there is no longer any case in controversy. Counsel, therefore, asks that the case be dismissed. Counsel for respondent has advised the Board that he has no objection to the dismissal. Accordingly, counsels' request to dismiss is granted.
