This dispute concerns a claim of $789,734 for work performed by appellant, 3D/I+Turner Joint Venture, for the General Services Administration (GSA) under contract number GS-05P-94-GBC-0051. The contract was for construction management services providing general oversight for multiple prime contracts executed directly by GSA for the construction of a new United States Courthouse in Cleveland, Ohio. From the time this case was docketed, counsel have been engaged actively in settlement discussions. As a result of a mediation conducted by a judge of this Board, the parties have resolved their dispute by compromise. Counsel for the parties have now moved the Board, pursuant to Rule 136(e), to enter judgment in accordance with their settlement in the amount of $725,000.00 plus statutory interest from July 11, 2003, until the date the judgment is paid. Both parties represent and stipulate that neither party will seek reconsideration of, or relief from, this decision and that neither party will appeal the decision. Pursuant to the agreement of the parties and Rule 136(e), the Board adopts the parties' stipulation by decision. This appeal is GRANTED IN PART in the amount of $725,000 plus statutory interest pursuant to the Contract Disputes Act, beginning on July 11, 2003, the date on which appellant submitted its certified claim to the contracting officer, and ending when this judgment has been paid. This award is to be paid from the permanent indefinite judgment fund, 31 U.S.C. 1304 (2000). _____________________________ EDWIN B.
