                              ORDER

     On June 26, 2003, James Construction filed a notice of appeal in connection with a
dispute under contract number GS-05P02GAC0116, for the renovation of part of the
Kinneary United States Courthouse in Columbus, Ohio.  On January 14, 2005, James
Construction filed a motion to dismiss, along with an executed settlement agreement,
requesting the appeal be dismissed with prejudice.

     Accordingly, this appeal is DISMISSED WITH PREJUDICE.  Rule 128(a).
