                              ORDER

     On June 5, 2003, Morrison Construction Services, Inc. filed a notice of appeal in
connection with a dispute under contract number GS-10P-00-LTD-0013, for remodeling a
grand jury room at the United States Courthouse in Spokane, Washington.  On December 8,
2003, respondent filed an executed settlement agreement and requested dismissal with
prejudice.  On January 22, 2004, appellant concurred with respondent and stated the appeal
may be dismissed.

     Accordingly, this appeal is DISMISSED WITH PREJUDICE.  Rule 128(a).
