                             ORDER

     On March 14, 2003, Petula-Midrise IV, LLC filed an appeal from respondent's
contracting officer's final decision denying a claim arising from the performance of a lease
entered into between appellant's predecessor-in-interest and respondent.  On August 15,
2006 the Board issued a decision denying appellant's motion for summary relief and
granting in part and denying in part respondent's motion for summary relief.  Petula-Midrise
IV, LLC v. General Services Administration, GSBCA 16085, 06-2 BCA  33,386.

     On November 21, 2006, appellant filed an unopposed motion to dismiss the appeal,
stating that the parties have reached an agreement to settle the appeal.



     Accordingly, the appeal is DISMISSED WITH PREJUDICE.
