ORDER On March 14, 2003, Petula-Midrise IV, LLC filed an appeal from respondent's contracting officer's final decision denying a claim arising from the performance of a lease entered into between appellant's predecessor-in-interest and respondent. On August 15, 2006 the Board issued a decision denying appellant's motion for summary relief and granting in part and denying in part respondent's motion for summary relief. Petula-Midrise IV, LLC v. On November 21, 2006, appellant filed an unopposed motion to dismiss the appeal, stating that the parties have reached an agreement to settle the appeal.
