This appeal involves a deemed denial of a certified claim in the amount of $6,089,205 for costs incurred by appellant for which respondent, General Services Administration (GSA), was allegedly responsible. The contract at issue, GS-09P-KTC-0014, was for the construction of a courthouse in Las Vegas, Nevada. Appellant supplied certain labor, equipment and material to GSA pursuant to the contract. The claim related primarily to the cost of steel and other structural elements designed and incorporated into the construction project. The parties have settled their dispute for $3,200,000, which, according to the parties' stipulation, is "inclusive of interest, costs and attorneys' fees." The parties have requested that the Board adopt their settlement by decision pursuant to Rule 136(e). The parties have stated that neither party will seek reconsideration of, or relief from, the Board's decision and that neither party will appeal the decision. Decision Pursuant to the agreement of the parties and Rule 136(e), the Board adopts the parties' stipulation by decision.
