Board of Contract Appeals General Services Administration Washington, D.C. 20405 ______________________________________ DISMISSED: December 11, 2002 ______________________________________ GSBCA 16001 INTERACTION RESEARCH INSTITUTE, INC., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Thomas D. Affourtit, President of Interaction Research Institute, Inc., Fairfax, VA, appearing for Appellant. Robert T. Hoff, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. NEILL, Board Judge. ORDER On November 18, 2002, the Board docketed this appeal from Interaction Research Institute, Inc. (IRI). At the time of docketing, no copy of the contracting officer's decision was furnished to the Board. Upon inquiry, IRI provided the Board with a contracting officer's decision dated August 6, 2001, and advised that it was appealing from that decision. From previous proceedings involving this same decision (GSBCA 15627), the Board was already aware that this decision, which purported to deny an uncertified claim in excess of $100,000, was a nullity. At a conference convened by the Board on December 10, 2002, the Board discussed with representatives of the parties its concern with the lack of jurisdiction over this case. Once apprised of the Board's concern, IRI's representative agreed to the dismissal of this case and assured the Board that, prior to returning, IRI would secure a contracting officer's decision on the specific amount of the original claim (now below $100,000) to which it believes it is still entitled. Counsel for respondent posed no objection to the proposed dismissal. Accordingly, this case is DISMISSED. ______________________ EDWIN B. NEILL Board Judge
