Board of Contract Appeals General Services Administration Washington, D.C. 20405 ________________________________________ GRANTED IN PART: May 8, 2002 ________________________________________ GSBCA 15821 6000 METRO LLC, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Richard D. Lieberman of McCarthy, Sweeney & Harkaway, P.C., Washington, DC, counsel for Appellant. Robert M. Notigan, Jr., Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. Before Board Judges DANIELS (Chairman), DeGRAFF, and WILLIAMS. WILLIAMS, Board Judge. On March 26, 2002, appellant, 6000 Metro LLC, appealed a General Services Administration contracting officer's deemed denial of its claim under contract number GS-03B-00367 regarding eight change orders relating to the preparation of the leased space at 6000 Metro Drive, Seton Business Park, Baltimore, Maryland. The Board docketed the case as GSBCA 15821. On April 18, 2002, the contracting officer issued a final decision on the claim stating, in pertinent part: [Y]ou made a claim for payment in the total amount of $25,823. After careful consideration of the facts, I conclude that it would be appropriate to pay your firm the amounts you requested for seven of the eight change orders. Regarding the change order for emergency lights and pull strings, you demanded $908, but I have determined that a payment of $877 is due, based upon the revised proposal you submitted for the change order on January 22, 2002. On May 6, 2002, appellant filed a motion for partial judgment requesting that the Board enter partial judgment in accordance with the contracting officer's final decision. Respondent has no objection. Accordingly, GSBCA 15821 is GRANTED IN PART in accordance with the contracting officer's final decision. The General Services Administration shall pay appellant $25,792, plus interest, as required by the Contract Disputes Act. Rule 136(e) (48 CFR 6101.36(e) (2000)). _________________________________ MARY ELLEN COSTER WILLIAMS Board Judge We concur: ______________________________ _________________________________ STEPHEN M.
