The Department of the Treasury's Internal Revenue Service terminated for the convenience of the Government a contract with Lucent Technologies, Inc. (Lucent), for the provision of a digital telecommunications switching system. The parties to the contract then entered into a termination settlement which excludes all rights and liabilities relating to a request for an equitable adjustment to the contract price which had been made by Lucent on behalf of subcontractor Telecommunications Management Associates, Inc. (now TMA Net, Inc.). Lucent submitted this request for an equitable adjustment as a claim, the contracting officer denied it, and Lucent appealed the contracting officer's decision to this Board. After an exchange of documents, counsel and their technical experts entered into discussions regarding the claim. On January 13, 2003, the parties filed a joint motion to dismiss the case.
