ORDER The parties to a contract for the renovation and adaptive reuse of the United States Post Office and Courthouse in Brooklyn, New York, exchanged correspondence regarding delays in performance of the contract. As part of this correspondence, the General Services Administration (GSA) contracting officer wrote to the contractor two letters which he denominated "final decisions." The contractor appealed these "decisions," but then moved to dismiss the appeals on the ground that the Board lacked jurisdiction because the letters were not in response to any contractor claims. GSA opposed the motion, contending that the cases were properly before the Board because the decisions which they appealed were Government claims. Much discussion regarding the underlying matters then ensued between the parties. On April 15, 2002, the parties filed a joint motion to dismiss the appeals.
