Board of Contract Appeals General Services Administration Washington, D.C. 20405 _____________________________________ DISMISSED: March 1, 2005 _____________________________________ GSBCA 15528 SEATTLE SECURITY SERVICES, INC., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Ralph Lewis, President of Seattle Security Services, Inc., Seattle, WA, appearing for Appellant. Jeremy Becker-Welts, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. Before Board Judges DANIELS (Chairman), PARKER, and BORWICK. PARKER, Board Judge. ORDER On March 14, 2001, Seattle Security Services, Inc. (SSSI) appealed the final decision of a General Services Administration (GSA) contracting officer terminating for default contract number GS-10P-00-LSD-0017 for guard services to federal facilities. While the appeal was pending, SSSI sought relief from its creditors by filing a voluntary Chapter 11 petition in the United States Bankruptcy Court for the Western District of Washington. The bankruptcy proceeding was later converted to a Chapter 7 liquidation. On October 24, 2004, the bankruptcy trustee filed in the Bankruptcy Court a motion to abandon the claim against GSA that was the basis for this appeal. The judge granted the motion, entering an order on November 17, 2004, abandoning the claim against GSA. GSA moved to dismiss the appeal on November 22, 2004. On December 9, 2004, the Board granted the motion to withdraw of SSSI's counsel and enlarged the time for SSSI to respond to GSA's motion to January 21, 2005. The order was sent to SSSI via United States Postal Service certified mail--return receipt requested. The certified mail form was signed as being received by SSSI on December 17, 2004. No response to GSA's motion was received from SSSI, and on January 27, 2005, SSSI was ordered to show cause by February 16, 2005, why this appeal should not be dismissed. The Board's show cause order was sent to SSSI via certified mail--return receipt requested. No response was received by the Board. Accordingly, the appeal is DISMISSED. ______________________________ ROBERT W. PARKER Board Judge We concur: ______________________________ ______________________________ STEPHEN M.
