                              ORDER

    Appellant, Jim Cooley Construction, Inc., appealed a General Services Administration
contracting officer's decision terminating for default contract number GS05P99GAC0197,
for the modernization of restrooms in a federal building in Chicago, Illinois.  On June 7,
2002, the Board received appellant's motion to dismiss.  A settlement agreement was
executed by both parties effective April 29, 2002, and appellant has requested that this appeal
be dismissed with prejudice.   Accordingly, the appeal is DISMISSED WITH
PREJUDICE.
