                                 ORDER
 
        On  October  11,  2000,  Scott  Burton  appealed  the  final
   decision of a General Services Administration contracting officer
   assessing liquidated damages in connection with two items awarded
   to Mr.  Burton under sale  number 93FBPS-00-0307.   On January 8,
   2001,   the  parties  filed   a  settlement  agreement,     joint
   stipulation,  and request for  dismissal of this  appeal, stating
   that  the controversy had  been amicably resolved  and requesting
   that the Board dismiss the appeal without prejudice.

        Accordingly,  this appeal  is  DISMISSED WITHOUT  PREJUDICE.
   This  dismissal  shall  convert  to  one  with  prejudice  ninety
   calendar days from the date of this order.  Rule 128(b).
