ORDER On September 29, 2000, appellant, Pat Mathis Construction Co., Inc., filed its appeal with the Board in connection with contract TFTC-97-7 with the Department of the Treasury, Federal Law Enforcement Training Center (FLETC) in Glynco, Georgia. Appellant was awarded the contract to construct a dormitory on the grounds of the FLETC. Respondent assessed liquidated damages for alleged late completion of the project. Appellant appealed the final decision of respondent. On May 23-24, 2001, and October 25-26, 2001, the Board held alternative dispute resolution (ADR) sessions with the parties. On January 8, 2002, the parties filed a joint motion to dismiss the appeal with prejudice. Accordingly, the appeal is DISMISSED WITH PREJUDICE. Board Rule 128. _____________________________ ALLAN H.
