These appeals arise from contract FCC 95-11, pursuant to which appellant supplied respondent with technical support and assistance to aid respondent in its use of competitive bidding to award licenses for portions of the electromagnetic spectrum. The first appeal was filed with this Board on April 18, 2000, from a contracting officer's final decision dated January 21, 2000, denying appellant's certified claim in the amount of $288,103.88. The second appeal was filed with this Board on October 19, 2000, from a contracting officer's final decision dated July 25, 2000, in which respondent asserted a claim for $453,896 against appellant. By order of the Board dated October 23, 2000, the appeals were consolidated. The parties agreed to participate in an alternative dispute resolution (ADR) proceeding with the panel chair serving as Board neutral. The ADR proceeding was conducted on December 5, 2000, and the parties agreed to a settlement during that proceeding. 2 On March 1, 2001, the parties filed a joint stipulation of dismissal of the consolidated appeals.
