                                 ORDER
 
        On  September  10,  1999, Hikmat  Sabeh  appealed  the final
   decision of a  Department of the Treasury,  United States Customs
   Service,  contracting officer denying  appellant's claim  for the
   refund of  the deposit  on property purchased  in Lots  210, 211,
   284A, 284B,  284C, and  284D, at the  Department of  the Treasury
   auction on  April 15, 1999, in  Edison, New Jersey.   On December
   20,  1999,  counsel for  appellant  informed  the  Board  that  a
   settlement agreement had  been executed and the  appeal should be
   dismissed.
 
        Accordingly, this appeal is DISMISSED WITH PREJUDICE.
