Board of Contract Appeals General Services Administration Washington, D.C. 20405 DISMISSED WITH PREJUDICE: June 13, 2001 GSBCA 15067 PAT MATHIS CONSTRUCTION CO., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Hubert J. Bell, Jr., of Smith, Currie & Hancock LLP, Atlanta, GA, counsel for Appellant. Gerald L. Schrader, Office of General Counsel, General Services Administration, Washington, DC; and M. Leah Wright, Office of Regional Counsel, General Services Administration, Atlanta, GA, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER This case involves a dispute as to how much the General Services Administration (GSA) owes Pat Mathis Construction Co. (Mathis) for performing additional work in connection with removal and reinstallation of columns and footings under a contract for the erection of the United States Courthouse in Albany, Georgia. GSA provided $110,000 in advance funding for this work. Later, Mathis claimed entitlement to $282,179 (inclusive of the $110,000), and the GSA contracting officer offered $168,006. At the joint request of the parties, a Board judge mediated the dispute. As a result of the mediation, the parties agreed that GSA would pay, and Mathis would accept, a total of $161,684 plus interest. Mathis has since been paid. The parties now ask that the case be dismissed with prejudice. Accordingly, the case is DISMISSED WITH PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
