On September 26, 1996, Trataros Construction and the General Services Administration entered into contract GS-02P-DTC-0033(N). The contract required Trataros to perform renovations and alterations at the United States Post Office and Courthouse Building in Old San Juan, Puerto Rico. In the course of performance, Trataros submitted several claims to GSA and the parties were not able to reach an agreement upon some of the claims. Six of those claims gave rise to these appeals. Trataros elected to use the Board's small claims procedure, and hearings were held on April 28, 29, and 30, 1999. The undersigned judge issued oral decisions in these cases, which were resolved as follows. The Board GRANTED GSBCA 14863 in the amount of $29,695.94, because GSA utilized a proprietary specification and rejected a substitute product proposed by Trataros that was the same standard of quality and was the functional equivalent of the product described in the specifications. The Board GRANTED IN PART GSBCA 14865 in the amount of $13,862.97, because GSA changed the work required by the terms of the contract. The Board denied part of this appeal, because GSA did not direct Trataros to perform the work for which Trataros claimed compensation. The Board GRANTED GSBCA 14866 in the amount of $20,602, because GSA changed the work required by the terms of the contract. The Board DENIED GSBCA 14868, because Trataros did not establish that GSA changed the work required by the terms of the contract. The Board DENIED GSBCA 14869, because Trataros did not establish that GSA changed the work required by the terms of the contract. The Board DENIED GSBCA 14870, because Trataros did not establish either that it provided GSA with a repair procedure that would have corrected problems with a concrete wall that Trataros constructed, or that GSA directed Trataros to tear down the wall. __________________________________ MARTHA H.
