Board of Contract Appeals General Services Administration Washington, D.C. 20405 DISMISSED: March 4, 1999 GSBCA 14860 WRD VENTURE, A PARTNERSHIP, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Nancy Pitt of WRD Venture, Tucson, AZ, appearing for Appellant. Martin A. Hom, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. NEILL, Board Judge. ORDER Appellant, WRD Venture, and respondent, the General Services Administration (GSA), entered into a lease for the Social Security Administration facility located in Albuquerque, New Mexico. Under Section 29 of the lease, the lessor, WRD Venture, was to be reimbursed by the lessee, GSA, for the cost of real estate taxes that exceeded the amount of such taxes in the base year of the lease. This appeal arises from a dispute between appellant and respondent over reimbursement of the 1997 real estate tax increase. On February 4, 1999, the Board suspended proceedings while the parties engaged in settlement negotiations. On March 3, 1999, appellant advised the Board that the parties have reached a settlement and requested that its appeal be dismissed with prejudice. Respondent has no objection to the dismissal. Accordingly, pursuant to Rule 128(a), this appeal is DISMISSED. ________________________ EDWIN B. NEILL 2 Board Judge
