ORDER On October 28, 1998, appellant, Envirofit, Inc., filed an appeal of a contracting officer's decision terminating for default its contract with the Department of Commerce for a heating, ventilation, and air conditioning system upgrade at the National Marine Fisheries in Woods Hole, Massachusetts. On October 30, 1998, the Board issued an order on further proceedings, which established filing dates for the pleadings in the appeal. On February 9, 1999, the parties filed a Stipulation of Dismissal with Prejudice, which stated that the terms of a settlement agreement have been fully effectuated and requested that the Board enter an order of dismissal.
