Board of Contract Appeals General Services Administration Washington, D.C. 20405 DISMISSED: August 10, 1999 GSBCA 14664 TGMI/CONTRACTORS, INC., Petitioner, v. GENERAL SERVICES ADMINISTRATION, Respondent. Joseph C. Kovars of Ober, Kaler, Grimes & Shriver, Baltimore, MD, counsel for Petitioner. Kevin J. Rice, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. GOODMAN, Board Judge. ORDER On August 7, 1998, petitioner, TGMI/Contractors, Inc. (TGMI), filed a petition to direct the contracting officer to issue a final decision on its claim. The Board issued an order on August 11, 1998, which directed the contracting officer to issue a final decision on TGMI's claim by September 10, 1998, or an explanation as to why one could not be issued by that time. On September 23, 1998, the Board convened the parties in a conference call to discuss the possibility of attempting to resolve this case through alternative dispute resolution (ADR). The parties agreed to ADR and the Board scheduled the proceeding for December 15, 1998, which was subsequently changed to January 20, 1999. The ADR on January 20, 1999, was unsuccessful and the parties agreed to another attempt at ADR, which was held on February 9, 1999. The parties settled the dispute during this proceeding. On August 4, 1999, petitioner's counsel filed a letter with the Board stating that the petition was fully settled and 2 satisfied and that the case may now be dismissed. Counsel for respondent concurs with petitioner's request for dismissal. Accordingly, pursuant to Rule 128(a), this petition is DISMISSED. ___________________________ ALLAN H. GOODMAN Board Judge
