Board of Contract Appeals General Services Administration Washington, D.C. 20405 DISMISSED WITHOUT PREJUDICE: September 15, 1998 GSBCA 14616 TWIGG CORPORATION, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. John E. Belt, Falls Church, VA, counsel for Appellant. Jeremy Becker-Welts, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER On June 18, 1998, Twigg Corporation appealed to this Board the General Services Administration's deemed denial of a claim the contractor had submitted under a contract for major renovation of Federal Office Building 6, which is located at Fourth and C Streets, S.W., in Washington, D.C. The contract required Twigg to install ductwork through elevator and stairway core walls. The claim was in the amount of $69,866, which, according to the complaint, represented the additional costs the contractor incurred in doing this work as a result of the walls being cast-in-place concrete, rather than concrete masonry, as indicated on the contract drawings. On August 28, 1998, Twigg informed the Board that it had "mischaracterized the nature of its claim" and "wishe[d] to rectify this situation by withdrawing its appeal in this matter without prejudice, and re-presenting its claim properly characterized in the matter before the contracting officer." The Government has no objection to this course of action. Accordingly, the appeal is DISMISSED WITHOUT PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
