                              ORDER

     In response to appellant's request and in the absence of any objection from counsel for
respondent, the Board DISMISSES this case WITHOUT PREJUDICE.  This dismissal
shall be deemed to be with prejudice upon the expiration of 180 calendar days from the date
of dismissal unless prior to that time the Board, for good cause shown, extends the 180 day
period or a party requests reinstatement of the case.  

     The Board's order of February 18, 1998, calling for a contracting officer's decision in
this case or an explanation of why one cannot be rendered at this time is rescinded.  

     In the event the contracting officer issues a decision regarding the claim which is the
subject of this case, this order shall in no way delay the running of the ninety-day period
provided in statute for an appeal of that decision.  41 U.S.C.   606 (1994).
