ORDER On January 20, 1998, All Purpose Services filed an appeal with the Board in connection with contract number GS-08P-93-JXC- 0103 with the General Services Administration. Appellant sought reimbursement for additional costs incurred in the performance of the contract at the Federal Building/Courthouse in Butte, Montana. The Board docketed the appeal as GSBCA 14474. While GSBCA 14474 was proceeding at the Board, appellant was pursuing another claim in the United States Court of Federal Claims in connection with the same contract. On November 12, the case was transferred to this Board for consolidation with GSBCA 14474. The Board gave the second appeal docket number GSBCA 14751. On June 3,1999, the parties filed a joint stipulation for dismissal without prejudice for sixty days which stated in part: Pursuant to Rule 128 of the Board's Rules of Procedure, All Purpose Services ("APS" or "Appellant") and the General Services Administration ("GSA" or "Respondent") respectfully request that the Board hereby dismiss without prejudice, for a period of sixty days, the above referenced appeal[s]. Upon expiration of the sixty days, the dismissal would convert to a dismissal with prejudice. Pursuant to a Settlement Agreement dated June 1, 1999, the parties have agreed to settle all of the issues embodied by th[ese] appeal[s], and any other issues related to the contract in question. In accordance with the parties' request and Board Rule 128, the appeals are hereby DISMISSED WITHOUT PREJUDICE for a period of sixty days, or until August 3, 1999. ________________________ ROBERT W.
