                                 ORDER
 
        This  appeal  arises  out  of  contract  GS-09P-93-KTC-0093,
   entered  into  by the  parties  for  the  construction of  a  new
   laboratory/office  facility  at   the  United  States  Geological
   Survey, Menlo  Park,  California.   On  December  10,  1998,  the
   appellant  submitted  to the  Board  a  request to  dismiss  with
   prejudice  this  appeal.    Respondent has  no  objection  to the
   dismissal of this appeal.
 
        Accordingly,  this appeal is DISMISSED WITH PREJUDICE.  Rule
   128(a).
