ORDER This appeal involves a claim under a construction contract for payment of those portions of wages paid to certain laborers on the project which were allegedly required to be paid by the General Services Administration, though they were in excess of minimum wage rates prescribed by the Department of Labor. The Board issued an interlocutory opinion in the case on June 23, 1998, denying the agency's motion to dismiss for failure to state a claim upon which relief can be granted. Twigg Corp. v. General Services Administration, GSBCA 14388, 98-2 BCA 29,835. At the parties' request, we subsequently scheduled a hearing in the case. Instead of proceeding to hearing, however, the parties decided to engage in settlement negotiations. On January 19, 1999, the appellant reported that a settlement had been formalized by appropriate modification to the contract. The appellant accordingly moved for a dismissal of the case.
