ORDER A Department of the Army contracting officer denied claims made by Custom Fabricating Industries, Inc., for payment on orders placed by that agency under a Federal Supply Schedule contract. The contracting officer told the contractor that if it was dissatisfied with her ruling, it could file an appeal with the Board of Contract Appeals. The contractor then filed this case. The General Services Administration (GSA), which administers Federal Supply Schedule contracts, moved to dismiss the case for lack of jurisdiction, since a GSA contracting officer has not yet issued a decision on the claims. In the motion, GSA explained that the Army contracting officer's advice as to appeal was not correct. GSA counsel offered to work with the appropriate contracting officer to resolve the matter in dispute. Custom Fabricating Industries then withdrew its appeal.
