                                 ORDER
 
        This appeal challenges the contracting officer s default
   termination of appellant s contract for construction of a
   training facility in Artesia, New Mexico, for the Federal Law
   Enforcement Training Center.  In accordance with the settlement
   agreement of January 21, 1998, and the contracting officer s
   letter of the same date withdrawing the default termination, the
   parties have settled their dispute and request dismissal of this
   appeal.  
 
        Pursuant to Rule 128(b), and the request of the parties,
   this appeal is DISMISSED.
