The Board docketed this appeal from a contracting officer's final decision on September 30, 1997. Boro Developers, Inc. (Boro) sought an equitable adjustment in connection with a contract with the General Services Administration for renovations to the Robert N.C. Nix Sr. Federal Building and Courthouse in Philadelphia, Pennsylvania. The parties participated in an Alternative Dispute Resolution session on July 10, 1998, and were able to resolve all disputes in this appeal. However, because of a related claim Boro filed in the United States Court of Federal Claims (Docket No. 96-180C), completion of the settlement agreement in the appeal before the Board was delayed. On December 27, 1999, the parties filed a joint motion for stipulated judgement which stated in part: The parties have reached a settlement in this appeal and have agreed to stipulate to the entry of judgment as follows: The General Services Administration will pay Boro Developers, Inc. the sum of $93,000, inclusive of any and all Contract Disputes Act interest, costs, and fees. The parties also represent and stipulate that neither party will seek reconsideration of, or relief from, the Board's decision, and that neither party will appeal the decision. Pursuant to Board Rule 136(e), the appeal is GRANTED IN PART.
