The General Services Administration (GSA) terminated for the convenience of the Government a contract held by Airo Services, Inc. (Airo), for the removal and replacement of underground storage tanks in the states of Washington and Idaho. Airo then submitted a termination for convenience settlement proposal, seeking $80,031. Later, it asked GSA's contracting officer to consider this proposal as a claim. After the contracting officer failed to issue a timely decision on the claim, Airo appealed to this Board from his deemed denial of it. Following the Board's denial of GSA's motion for summary relief (Airo Services, Inc. v. General Services Administration, GSBCA 14301, 98-2 BCA 29,909) and a hearing on the merits of the case, the parties resumed settlement negotiations. They have now filed a Stipulation for Entry of Judgment in which they jointly ask the Board to enter judgment "in favor of appellant and against respondent, in the amount of Seventy five thousand dollars ($75,000), inclusive of all attorneys fees and costs. Interest pursuant to the Contract Disputes Act of 1978, 41 U.S.C. 601-613, shall begin to run on June 30, 1997." The parties have agreed not to seek reconsideration of, or relief from, a decision containing such a judgment, and not to appeal the decision. Decision The appeal is GRANTED IN PART. GSA shall pay to Airo $75,000 plus interest on that amount, at the rate prescribed pursuant to the Contract Disputes Act, 41 U.S.C. 611 (1994), from June 30, 1997, until the date of payment.
