This case arises under a contract which required Digicon Corporation (Digicon) to provide to the Department of Commerce (Commerce) services and equipment to support the efforts of a Commerce bureau, the National Technical Information Services (NTIS), to enhance the NTIS FEDWORLD electronic dissemination system. Digicon claims that it is entitled to receive $119,931.46 more than Commerce paid as a fee for work performed under the contract. The parties have now filed a Stipulation for Entry of Award, which reads as follows: The parties, through counsel, having agreed to a settlement in this matter resolving all issues raised in the subject appeal, and the parties desiring to effectuate payment of this settlement through the "Claim and Judgment Fund," hereby request that the Board enter a decision in this case, granting an award to the Appellant in the sum of $87,500. The parties, through counsel, hereby waive any right to file a request for reconsideration of this award, or to take an appeal of this award. Counsel for the Respondent, upon entry of this award by the Board, shall execute any and all documents necessary to effectuate the terms and intent of this stipulation.
