ORDER Twigg Corporation claimed that the General Services Administration owed it $63,354 under a contract for renovation of the Columbia Plaza office complex in Washington, D.C. According to Twigg, the parties had agreed on a price for additional work to be performed in accordance with drawings for a modified design of two floors of the building; the price for the electrical portion of the work had not included the installation of dimming fixtures; the agency had required the installation of these fixtures; and the claimed amount was the cost of supplying and installing them. The contracting officer was deemed to have denied the claim, and Twigg appealed. The parties submitted this case to alternative dispute resolution, with the Board judge to whom the case was assigned acting as the neutral. In an informal round-table discussion, each side presented its views as to the facts and controlling legal precedents regarding the matter. The judge provided an assessment of the strengths and weaknesses of each position. After hearing this assessment, the parties negotiated a settlement of the case. Shortly after the alternative dispute resolution session, Twigg filed a motion to dismiss the case. The motion states that the agency has issued a contract modification to implement the terms of the settlement. Twigg's unopposed motion is granted.
