                                   ORDER

     The parties have moved pursuant to Board Rule 128 to dismiss
this appeal without prejudice; counsel have advised the appeal is
settled.  In their papers, the parties moved for dismissal without
prejudice to reinstatement within one hundred and eighty calendar
days from the date of dismissal.  During a telephone conference
with the Board, counsel amended the request to provide for
reinstatement no later than May 3, 1997, which is ninety days after
the date of the contracting officer's final decision in this
appeal.  Since May 3, 1997, is a Saturday, the date is extended
until Monday, May 5, 1997.  Pursuant to the request of the parties
and Board Rule 128, this appeal is DISMISSED WITHOUT PREJUDICE to
reinstatement on or before May 5, 1997.
