ORDER On October 22, 1996, this Board received the appeal from a decision of the General Services Administration (GSA) contracting officer dated June 22, and delivered to the appellant on June 22. Respondent filed a motion to dismiss for lack of jurisdiction on the ground that the appeal was filed at this Board more than ninety days after receipt of the contracting officer's decision. To avoid jurisdictional problems, the contracting officer issued a new decision on appellant's claim, and appellant filed a new appeal at this Board, which we docketed as GSBCA 14096. Appellant seeks dismissal of this appeal without prejudice to appellant's right to pursue GSBCA 14096. Respondent agrees. This appeal is DISMISSED.
