ORDER Appellant was awarded a contract on June 4, 1996, for custodial and related services at the United States Customs House and United States Border Station in Pembina, North Dakota. The term of the contract was June 12, 1996, through December 31, 1996, with four one-year option periods. On August 6, 1996, the contracting officer issued a final decision which terminated the contract for appellant s failure to perform. Appellant filed an appeal with this Board on September 23, 1996. On September 24, the Board issued an order on further proceedings. On October 17, the parties advised the Board that a tentative settlement had been reached and requested a sixty-day stay of proceedings, which the Board granted on October 18. On November 13, the parties filed a settlement agreement, which stated in part: WHEREAS, the Government and TQM desire to leave the termination for default in place and effect a full settlement and mutual release of all further causes of action, appeals, claims, disputes, demands for relief or remedies . . . . NOW THEREFORE, in consideration of the foregoing premises, the Government and TQM do hereby agree as follows: 1. THAT, within ten (10) days after the execution of this settlement agreement [executed on November 8, 1996], TQM shall withdraw with prejudice its appeal from the GSBCA; Appellant filed the aforementioned withdrawal on November 18.
