BORWICK, Board Judge.

                                   ORDER

     On August 13, 1996, appellant filed an appeal at this Board
from the contracting officer's decision denying appellant's claim. 
Appellant had claimed $94,172 in repair costs associated with a
terminated lease between appellant and respondent, General Services
Administration (GSA).  The Board set the case for hearing
commencing on December 17.  The parties notified the Board that
they were settling their dispute, and that a hearing would not be
necessary.  On February 5, counsel for appellant advised the Board
that a settlement had been reached and that appellant had been paid
by GSA in full settlement of the claim.  Appellant requested that
the case be dismissed with prejudice.  Respondent agrees.  Pursuant
to Rule 128 and the agreement of the parties, this appeal is
DISMISSED.
