On June 14, 1996, appellant Kennedy Kars appealed the final decision of a General Services Administration (GSA) contracting officer denying Kennedy Kars' claim for cancellation of a purchase of a vehicle at Auction Sale 4KBPS95083 and a refund of the sales price of $7,000. Appellant claimed that the vehicle was misdescribed. The Board convened a telephonic conference on September 11, 1996, and scheduled record submissions. On October 29, 1996, the parties filed a settlement agreement, wherein GSA agreed to pay Kennedy Kars the sum of $2,500 as full and complete settlement of all claims under GSBCA 13621 and under the contract at issue. The parties agreed that the sum shall be paid from the permanent indefinite judgment fund. Both parties have executed certificates of finality providing that they will not seek reconsideration of, or relief from, the Board's decision and that they will not appeal that decision. In accordance with Rule 36(e), the Board adopts the parties' stipulation by decision and enters judgment as requested. Rule 36(e) permits the Board to adopt the parties' stipulation of settlement, by decision, and it provides that such decisions are adjudications of the appeal on its merits. Strand, Inc. v. General Services Administration, GSBCA 12434 (June 9, 1994). Decision Pursuant to the stipulation of the parties, this appeal is GRANTED IN PART.
