Board of Contract Appeals General Services Administration Washington, D.C. 20405 GRANTED IN PART: June 4, 1998 GSBCA 13594 TWIGG CORPORATION, Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. John E. Belt, Falls Church, VA, counsel for Appellant. Gerald L. Schrader and Scarlett D. Grose, Real Property Division, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. Before Board Judges DANIELS (Chairman), VERGILIO, and DeGRAFF. DANIELS, Board Judge. The General Services Administration (GSA) entered into a contract with Twigg Corporation (Twigg) for renovation of portions of the Columbia Plaza Office Complex in Washington, D.C. Twigg submitted to the agency's contracting officer a claim for $641,708, representing costs allegedly incurred by the contractor and various of its subcontractors resulting from the discovery and removal of asbestos at the construction site. In response, the contracting officer issued a unilateral modification to the contract in the amount of $328,866. Twigg later filed with this Board an appeal from the contracting officer's deemed denial of the remainder of the claim, and we docketed the case as GSBCA 13594. The parties have now agreed that in full settlement of the claim at issue in this case, GSA will pay to Twigg the sum of $70,000, plus interest thereon at the rates set by the Secretary of the Treasury (pursuant to Public Law 92-41 (85 Stat. 97) for the Renegotiation Board), from January 30, 1996, until paid. The parties have also asked the Board to adopt this stipulation by decision, and they have agreed not to appeal the decision. Rule 136(e) (48 CFR 6101.36(e) (1997)). Decision The appeal is GRANTED IN PART. GSA shall pay to Twigg $70,000, plus interest calculated in the manner agreed upon by the parties. _________________________ STEPHEN M.
