ORDER On September 16, 1992, appellant was awarded contract number 50-WCNA-206096 by respondent, the Department of Commerce, for the construction of a Weather Forecast Office in Mt. Holly, New Jersey. On July 20, 1994, appellant submitted a certified claim to the contracting officer in the amount of $546,102.14 for an equitable adjustment in contract price and an extension of time in the period of performance. The contracting officer issued a final decision on December 21, 1995, which denied all but $13,850 of appellant's claim. Appellant filed a notice of appeal at this Board on March 21, 1996. 2 On November 12-13, 1997, an alternative dispute resolution (ADR) proceeding was held at the Weather Forecast Office in Mt. Holly, New Jersey. At the conclusion of the ADR proceeding, the parties agreed to settle the case based upon terms and conditions set forth in a written settlement agreement. On April 20, 1998, appellant and respondent filed a joint request for dismissal which states that "[t]he conditions of the settlement agreement have been fulfilled and therefore the parties jointly request that the Board enter an Order dismissing this case with prejudice to the refiling of same."
