ORDER This appeal arises out of lease number GS-09B-88335 between appellant, 210 Earll L.L.C., and respondent, the General Services Administration (GSA), for 128,845 net usable square feet of office and related space. Appellant is the succeeding lessor to the original lease between GSA and the original lessor. The issue in dispute involves a certified claim by appellant for additional rent based on the increase in real estate taxes over the base year, per the lease. The claim was submitted to the contracting officer on February 28, 1995, and the contracting officer issued a final decision denying the claim on May 1, 1995. This appeal was docketed as GSBCA 13389 on July 21, 1995. On January 15, 1997, the parties participated in an alternative dispute resolution proceeding conducted by the presiding Board Judge that resulted in a settlement of the appeal. The parties agreed to file a motion to dismiss the appeal upon execution of a supplemental lease agreement and a settlement agreement. On August 7, 1997, counsel for appellant withdrew its appeal with prejudice based on executed copies of the settlement agreement and supplemental lease agreement between the two parties. Counsel for respondent concurs with appellant's withdrawal of its appeal. Accordingly, this appeal is DISMISSED. Rule 128(a). ____________________ ALLAN H. GOODMAN Board Judge
